"हुर्रे": Uttarakhand sets a historic milestone as India’s first state to implement the UCC Act, bringing clarity, fairness, and harmony by mandating marriage registration within 60 days, safeguarding rights, and simplifying processes online & offline
In a historic step towards reforming personal laws, Uttarakhand on Wednesday notified the Uniform Civil Code (UCC), which aims to bring clarity to legal provisions related to marital conditions, protection of individual rights, and fostering social harmony. This landmark decision places Uttarakhand in the spotlight as the first state in India to implement the UCC, a move that has been discussed and debated for decades in the country.

According to the official statement released by the state government, the Uniform Civil Code applies to the entire state of Uttarakhand and extends its jurisdiction to residents of Uttarakhand living outside the state. This broad applicability ensures that personal laws related to marriage, divorce, inheritance, and succession are streamlined and standardized for the state's residents, regardless of their physical location.
What sets this implementation apart is its inclusivity while also respecting certain exceptions. The UCC applies to all residents of Uttarakhand except Scheduled Tribes (ST) and communities or individuals protected under special provisions of the Constitution. Specifically, Scheduled Tribes notified under Article 342 and Article 366 (25), as well as those falling under the category of protected authority-empowered persons and communities listed in Part XXI of the Constitution, are excluded from the purview of this Act.
The notification of the UCC by Uttarakhand is being hailed as a significant step toward achieving uniformity in personal laws, while carefully balancing constitutional provisions that protect certain communities. This decision reflects the state’s intent to ensure equality and harmony while respecting India’s diversity.
The government’s move marks a turning point in India's legal and social framework, and it remains to be seen how this decision will influence other states in the country. As Uttarakhand leads the way in implementing the UCC, it paves the path for debates and discussions on this progressive reform at the national level.
The Uniform Civil Code (UCC) Act, 2024, introduced by the Uttarakhand government, aims to simplify and streamline legal processes concerning marriage while upholding the principles of individual rights and social harmony. The official statement emphasized that the Act establishes a public welfare framework to ensure clarity and fairness in marital conditions, a critical aspect of the state's progressive legal reform.

As per the provisions of the Act, marriage can only be solemnized between individuals who meet specific criteria. These include the stipulation that neither party should have a living spouse, both individuals must be mentally capable of providing legal consent, the man must have completed 21 years of age, and the woman must be at least 18 years old. Additionally, the Act prohibits marriages between individuals who fall under the ambit of restricted relationships.
The Act accommodates marriage rituals performed under both religious customs and legal provisions, providing flexibility to individuals based on their preferences. However, a mandatory provision requires all marriages solemnized after the Act's implementation to be registered within 60 days.
For marriages that occurred between March 26, 2010, and the implementation of the Act, couples are required to register their unions within six months. On the other hand, individuals who have already registered their marriages under the prescribed standards need not re-register but must acknowledge the prior registration.
The Act also addresses marriages that were solemnized before March 26, 2010, or outside Uttarakhand. If the couple has been living together since that time and meets all legal eligibility criteria, they are provided an option to register their marriage within six months of the Act coming into effect. However, registration for such cases is not mandatory.

Additionally, the Act ensures a time-bound process for marriage registration. The responsibility falls on the sub-registrar to accept and acknowledge marriage registration applications promptly. According to the guidelines, the sub-registrar must issue an appropriate decision within 15 days of receiving the application, ensuring minimal delays in the process.
With these provisions, the Uniform Civil Code Act, 2024, introduces a structured approach to marriage laws in Uttarakhand, focusing on fairness, clarity, and the protection of individual rights while maintaining social harmony.
The UCC Act, 2024 introduces a streamlined and transparent process for marriage registration. According to the official statement, if no decision is made on a marriage registration application within the prescribed period of 15 days, the application is automatically forwarded to the registrar for further processing. For cases involving the acknowledgment of an already registered marriage, the application will be considered automatically accepted after the same 15-day period.
To ensure fairness, the Act provides for a transparent appeal process. If an application for marriage registration is rejected, the applicant has the right to appeal the decision. This mechanism ensures that individuals are not left without recourse and that errors in judgment can be addressed promptly. However, strict measures have been introduced to maintain the integrity of the process. A penalty has been instituted for providing false information during the registration process.
Despite the mandatory registration requirement, the Act clarifies that a marriage will not be considered invalid solely due to non-registration. This provision ensures that the legal validity of a marriage is not undermined by procedural lapses, reflecting a balanced and considerate approach by the state government.
To facilitate the registration process, the government has made it possible to register marriages through both online and offline modes, providing convenience to residents across Uttarakhand. Moreover, the state government will appoint key officials, including a registrar general, Registration, and sub-registrar, to oversee the maintenance and monitoring of marriage records. This step ensures proper implementation and administration of the Act.
In addition to streamlining the process, the UCC Act provides clear guidelines on who can marry, how marriages are to be solemnized, and how both new and existing marriages can be legally recognized. This comprehensive framework ensures that personal laws related to marriage are not only simplified but also uniformly applicable, creating a sense of clarity and fairness for all residents of the state.
