In a major legal development, a dedicated special court in Bengaluru—established specifically to hear cases involving Members of Parliament (MPs) and Members of Legislative Assembly (MLAs)—has formally convicted Vinay Kulkarni.

 

The prominent Congress leader and sitting MLA from Dharwad was found guilty of orchestrating the murder of Yogesh Gowda, a well-known local BJP leader. The judicial bench handed down the guilty verdict for murder and criminal conspiracy on Wednesday, April 15. While he was convicted on these severe charges, the court ultimately cleared him of offenses under the Arms Act. The exact punishment will be determined when the court announces its final sentence on Thursday, April 16.

To reach this verdict, the Central Bureau of Investigation (CBI) conducted an exhaustive inquiry. During the course of their rigorous investigation, the central agency examined as many as 113 witnesses to build a solid narrative of the crime. Kulkarni’s legal battles have been incredibly lengthy and complex. He was initially taken into custody in 2020 and spent more than nine months behind bars. He received temporary relief when the Supreme Court of India granted him bail on August 11, 2021. However, this freedom was revoked when his bail was officially cancelled on June 6, 2025.

After a long and highly scrutinized trial, the court has now found him guilty, and sentencing has been adjourned to the next day (Thursday, April 16). Because Kulkarni has been convicted under Section 302 of the Indian Penal Code, which dictates that murder is punishable with life imprisonment or death based on the court’s discretion, his political career is effectively paralyzed. Furthermore, as per the strict rules of the Representation of the People Act, 1951, any elected representative sentenced to two years or more in jail is automatically disqualified from their position. The legal shield that historically allowed sitting lawmakers to retain their seats during an appeal process was entirely removed after the Supreme Court’s judgment in the Lily Thomas case.

Tracing the Roots of the Crime

The origins of this high-profile political assassination trace back nearly a decade to June 15, 2016. On that day, Yogesh Gowda, who served as a BJP Zilla Panchayat member, met a violent end. As stated in the primary reports, Yogesh Gowda was shot dead inside a gym in Dharwad, Karnataka. At the time of this brazen daylight killing, Kulkarni held a powerful position, serving as a cabinet minister in the Karnataka state government. As the dust settled, his name emerged prominently as one of the key accused in the conspiracy behind the killing.

In the immediate aftermath, the local state police handled the investigation. However, the trajectory of the probe shifted dramatically a few years later. In 2019, when the BJP came to power in Karnataka, the administration officially handed the sensitive case over to the Central Bureau of Investigation. Taking over the reins, the CBI dug deeper and filed a comprehensive supplementary chargesheet against Kulkarni. This legal document formally accused the Congress leader under several sections of the law, cementing the charges of criminal conspiracy and murder that have now culminated in his conviction.
