The BNS's sections 115(2), 351(2), 351(3), and 352, as well as the pertinent clauses of the Muslim Women (Protection of Rights on Marriage) Act, 2019, were invoked to book a case against the accused.

Thane: Sohail Gives Triple Talaq to His Second Wife for Refusing to Have Sex with His Boss
A deeply disturbing case has emerged from Kalyan in the Thane district of Maharashtra, where a software engineer, identified as Sohail Shaikh, allegedly issued triple talaq to his second wife for refusing to comply with his shocking demands. The incident unfolded over a series of distressing events between 7th and 20th December, revealing a grim reality of abuse and coercion within the relationship.

The case came to light on 19th December, when the 28-year-old victim, unable to endure further torment, sought refuge at the Sambhaji Nagar police station. According to reports, Sohail Shaikh, who works in a private company, initially demanded that his wife engage in a sexual relationship with his boss during a party. When she firmly refused, the situation took a darker turn. In an outrageous escalation, Sohail further demanded that she procure ₹15 lakh from her parents to support his first wife, a demand that the victim again rejected.

Enraged by her defiance, Sohail resorted to verbal and physical abuse. On 5th December, a heated argument spiraled into violence when she returned home, resulting in her being attacked and threatened with murder. Reports indicate that Sohail's behavior became increasingly erratic and aggressive, culminating in him issuing the illegal and condemned practice of triple talaq—a practice banned in India since 2019 under the Muslim Women (Protection of Rights on Marriage) Act.

Following the assault and being forced out of her residence, the victim approached the Sambhaji Nagar police station on 19th December. Her case was subsequently transferred to the Bazarpeth police station on 20th December for further investigation. Law enforcement agencies are now probing the sequence of events, including the involvement of the accused’s boss and the illegal demands for money.

The case against Sohail Shaikh, the software engineer from Kalyan accused of giving triple talaq to his second wife, has taken a legal turn under stringent sections of the law. The authorities invoked sections 115(2), 351(2), 351(3), and 352 of the Bharatiya Nyaya Sanhita, along with relevant provisions of the Muslim Women (Protection of Rights on Marriage) Act, 2019, to book him for his actions. This case sheds light on the persistent abuse and exploitation the victim endured after what initially seemed to be a happy marriage.

According to reports, the couple tied the knot in January 2024. For the first few months, the marriage appeared blissful. However, cracks soon began to show when Sohail started demanding money from his wife and subjecting her to physical and mental abuse. To her shock, the victim discovered that her husband’s divorce from his first wife was still pending, a fact he had concealed during their courtship and marriage.

Senior Police Inspector Sureshsing Gaud from the Bazarpeth police station provided further insights into the case. “The complainant got married to the accused in January 2024. The accused wanted to give talaq to his first wife to live with the complainant peacefully. However, he demanded Rs 15 lakh from the complainant to give to his first wife for the divorce,” he explained. The victim’s refusal to comply with Sohail’s demands led to escalating abuse, culminating in an appalling episode where she was asked to attend a party and sleep with his boss.

Despite her resistance, Sohail continued his coercive and violent behavior. When she refused to meet his humiliating demands, he not only thrashed her but also pronounced triple talaq in front of relatives after returning home. The victim’s allegations paint a grim picture of the systematic harassment she faced at the hands of her husband, who seemingly had no intention of honoring the sanctity of their marriage.

This shocking series of events has raised serious concerns about the effectiveness of existing laws in protecting women from such exploitation. As the investigation continues, the case highlights the importance of creating awareness about legal protections and ensuring swift justice for victims of domestic abuse and illegal practices like triple talaq.
