The landmark judgment follows an extensive trial concerning atrocities committed throughout the nation's catastrophic civil war. Handing down identical capital punishments in the same landmark case, the tribunal also sentenced Assad's younger brother, Maher Al-Assad, alongside their maternal cousin, Atef Najib.

The verdicts delivered at the Fourth Criminal Court in Damascus represent the very first major court action against prominent figures of the Assad regime since their family’s more than 50-year reign collapsed.

The judicial panel formally found Bashar Al-Assad accountable for horrifying infractions across Syria’s nearly 14-year conflict, ruling that his actions constituted undeniable war crimes and crimes against humanity. What initially began as peaceful civilian protests in 2011 rapidly escalated into a full-scale armed conflict, ultimately resulting in approximately half a million deaths and displacing millions of citizens both internally and across global borders.

Presiding over the historic session that was broadcast live across national state television, Judge Fakhareddine Al-Aryan delivered a definitive assessment of the former regime's systemic abuses:

“Bashar Assad used state agencies to commit war crimes and crimes against humanity.”

Former Security Chief Atef Najib Handed Capital Punishment

Atef Najib, a former Syrian army brigadier general and maternal cousin to Assad, was sentenced to capital punishment for his direct role in the state violence. In 2011, Najib served as the head of the Political Security Branch in the southern province of Daraa, the region widely recognized as the cradle of the Syrian uprising.

The court established that Najib spearheaded the brutal crackdown on early peaceful demonstrators in Daraa. He was convicted of horrific acts, including the deliberate killing of children under the age of 15 and overseeing fatal torture practices. Categorizing these heinous actions as crimes against humanity, the judicial panel applied the death penalty—the absolute harshest punishment available under the law. Judge Al-Aryan noted that Najib retains the right to appeal his sentence.

Unlike Bashar and Maher Al-Assad, who evaded capture, Najib was detained within Syria and stood trial in person, making him one of the highest-ranking former government officials to physically face justice following the fall of the Assad regime. Under stringent security protocols, Najib stood inside a metal cage wearing a standard prisoner’s uniform as the judge read the verdict aloud, while large crowds gathered outside the central Damascus courthouse.

Reflecting the emotional atmosphere surrounding the courtroom, attorney Adnan Al-Masalmeh, who represented the families of Najib’s victims, shared a poignant statement:

Fleeing to Moscow and the Uprising's Catalysts

Bashar Al-Assad and his brother Maher fled the capital alongside immediate family members, seeking refuge in Moscow after Islamist-led opposition forces captured Damascus in December 2024. Following the collapse of the decades-long regime, Ahmed al-Sharaa—a former Al-Qaeda commander who was previously designated a terrorist by Washington—assumed leadership over the nation and formed a transitional government.

The Assad family’s iron-fisted rule spanned over five decades, initiated by Hafez Al-Assad and maintained by his son Bashar. The 2011 Arab Spring demonstrations devolved into a devastating civil war after state security forces responded with unyielding violence. According to verified documentations by the Syrian Observatory for Human Rights, the conflict claimed well over 500,000 lives and forced millions to seek refuge in neighboring countries like Lebanon, Jordan, and Turkey, as well as several European nations.

Najib’s personal record of brutality was central to this escalation. Sanctioned by the U.S. Department of the Treasury in April 2011, his tenure in Daraa was defined by extreme repression. During his leadership, over a dozen young teenagers were arrested and severely tortured simply for scrawling anti-government graffiti on a school wall. This incident served as the primary catalyst for mass national protests against the regime's security apparatus, which ultimately spiraled into a 14-year war culminating in Assad's ouster via a swift rebel offensive.

Victims of Najib’s crackdowns attended the trial, including individuals who were young teenagers during the 2011 events. Speaking to reporters from The Associated Press, Mouawiya Sayasneh reflected on the long-awaited verdict:

“Today we reached a point where the blood was not wasted. There is happiness that Atef Najib was sentenced to death.”

Another survivor, Nayef Abazeid, who was detained at just 13 years old in 2011, echoed those sentiments regarding the sentence, adding:

“Our biggest happiness will be when Bashar Assad is executed.”

Maher Al-Assad previously commanded the military’s notorious 4th Armored Division. Human rights groups and opposition activists have long accused this unit of widespread torture, systemic extrajudicial killings, extortion, drug trafficking, and operating clandestine detention facilities.
